Delhi High Court stays Environmental Clearance of Borga mines in Goa

The Delhi High Court on Friday i.e 11th September 2009 stayed the Environmental Clearance granted to the Borga Mines of Pandurang Timblo Industrias in Goa (Sanguem Taluka) . The Order passed by a Division Bench of the High Court comprising of Justice Madan B. Lokur and Justice A.K Pathak on a Petition filed by local group called Uttakarsh Mandal cited two major reasons for staying the clearance:

The EAC did not consider the large scale opposition to the project at the time of Public Hearing and the fact that both the Goa State Agricultural Marketing Board and the Gram Sabha had opposed the project; and
That the EIA Report was made available only 9 days before the Public Hearing whereas it should have been available 30 days in Advance. In such a situation it becomes an effective hearing.
The Petitioners have made a prima facie case of irreparable damage to the ecology due to mining and therefore interim stay needs to be granted.


We had filed an Appeal before the NEAA about two years back and as expected it was dismissed by the NEAA against which we filed a Writ in the High Court.

The case is now listed for hearing on the 8th of October.
